1. Acceptance of Terms
By accessing or using MyMoodScan (the “App”), you agree to be bound by these Terms of Use (“Terms”) and MorphCast Inc.’s Privacy Policy. If you do not agree, do not access or use the App.
2. Free Personal Licence
MorphCast Inc. (“MorphCast,” “we,” “us,” “our”) grants you a non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes only. You may create a home-screen shortcut or install the App as a progressive web app on your device.
3. No Fees, No Ads
MyMoodScan is provided free of charge and ad-free. We may display occasional in-app notices inviting you to share the App or send feedback—these notices are not advertising.
4. Functionality & Limitations
- The App performs on-device analysis of images or camera frames to infer facial expressions and apparent emotions.
- The analysis results remain in your browser; MorphCast does not receive or store your photos, camera feed, or any emotional data.
- MorphCast receives only aggregated, anonymous statistics (e.g., number of sessions started and total usage time) to understand overall usage and improve the service.
- Results are estimates only and may be inaccurate or incomplete. Do not rely on them for medical, legal or professional decisions.
5. User Conduct
You agree not to:
a) upload images that you do not have the right to process;
b) use the App to harass, defame or infringe the privacy of others;
c) reverse-engineer, modify or create derivative works of the App;
d) use the App for commercial or research purposes without prior written consent from MorphCast.
6. Intellectual Property
All intellectual-property rights in the App and underlying technology belong to MorphCast. You may display and share screenshots or results for personal use provided you credit “MyMoodScan by MorphCast.”
7. Disclaimer of Warranties
MyMoodScan is provided “as is” and “as available.” MorphCast disclaims all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not guarantee that the App will be error-free or that results will be accurate.
8. Limitation of Liability
To the maximum extent permitted by law, MorphCast shall not be liable for any indirect, incidental, special or consequential damages, or for any disputes arising out of insights gained from the App. Your sole remedy is to stop using the App.
9. Indemnity
You agree to indemnify and hold MorphCast harmless from any claims or damages arising out of your breach of these Terms or misuse of the App.
10. Updates & Termination
We may update or discontinue the App or these Terms at any time. Continued use after an update constitutes acceptance of the revised Terms. We may terminate or suspend your access at our sole discretion.
