Summary:
The “Premier Support Terms of Use” for MorphCast provides monthly support for the integration and use of MorphCast products, lasting one month with a maximum of 10 support hours during CET business hours. The cost is $650.00 per month. Support requests must be submitted via email, and MorphCast commits to responding within 24 hours. By accepting these terms, users agree to all conditions, including ethical codes and guidelines for responsible product use. MorphCast offers no additional guarantees, and services are intended for professional use only. Intellectual property rights remain with MorphCast, and support may be suspended or terminated for TOU violations. U.S. laws apply, with disputes resolved in San Francisco, CA courts. Service Overview:
Premier Support: Monthly support for the integration or use of MorphCast products.
Terms & Conditions
Duration:
The support services covered under this agreement will last for one month from the start date of acceptance of this proposal.
Maximum Hours:
The service provision under this agreement will not exceed 10 hours of support within the contracted month.
Service Hours:
Support services will be available during the normal business hours of banks in the Central European Time (CET) zone.
Response Time:
The service provider commits to responding to any support ticket or inquiry within 24 hours, provided that the ticket is received during the Service Hours.

Cost:
$650.00 per month (plus applicable taxes, if required)
Acceptance:
By accepting these Terms of Use (TOU), you signify your full acceptance of all provisions contained herein and agree to abide by our Ethical Code and Guidelines and Policies for responsible use of MorphCast products.
Use of Service:
The support services must be used as provided, and you may not modify, reverse engineer, or distribute any part of the service without explicit permission from MorphCast Inc.
Guarantee and Disclaimer:
MorphCast Inc. provides the support services with reasonable care and skill but without any additional guarantees. The services are intended solely for business use, and consumer protection laws do not apply.
Intellectual Property:
The intellectual property related to the support services and MorphCast products remains the exclusive property of MorphCast Inc. You may not use, reproduce, or distribute any intellectual property without explicit authorization.
Service Suspension and Termination:
MorphCast Inc. reserves the right to suspend or terminate your access to support services for any breach of these TOU or any other reason at their discretion.
Limitation of Liability:
MorphCast Inc., its affiliates, or any party involved in providing the support services will not be liable for any direct, incidental, consequential, or punitive damages arising from your use of the services.
Indemnification:
You agree to indemnify, hold harmless, and defend MorphCast Inc. from any claims or damages arising from your use of the support services, including any breach of these TOU or infringement of intellectual property rights.
Governing Law and Dispute Resolution:
These TOU are governed by the laws of the United States, including those of California and Delaware. Any disputes will be submitted to the exclusive jurisdiction of the courts of San Francisco, CA. Claims must be filed within six months of the incident giving rise to the claim.
Miscellaneous and Contact Information:
No joint venture, partnership, employment, or agency relationship exists between MorphCast Inc. and the User as a result of these TOU or the use of the Services. These TOU, and any rights and licenses granted hereunder, may not be transferred or assigned by you but may be assigned by MorphCast Inc. without restriction.
